The State of Virginia General Assembly has refused to act on the menhaden cap in the Chesapeake as ordered by the Atlantic States Marine Fisheries as well.
Virginia's attorney general, has offered the opinion that the state should not be required to abide by the cap since the ASMFC has no constitutional right to order it.
Unless the Va. Governor commands the state to comply with the ASMFC ruling, the matter appears headed for the courts, since any state found out of compliance with ASMFC rules could have all fishing for the involved species banned.
